They are focused on site specific mitigation of the impact of development. S106 agreements are often referred to as 'developer contributions' along with highway contributions and the Community Infrastructure Levy.2015-03-16T12:50:19.387012+00:00https://ckan.publishing.service.gov.uk/dataset/b7915314-eb4e-4bba-afee-0ada361c34daTree Preservation Orders2016-02-10T18:36:50.327668+00:00Tree Preservation Orders. These are written orders made by a local planning authority (e.g. a borough, district or unitary council or a national park authority) which makes it an offence to cut down, top, lop, uproot, wilfully damage or wilfully destroy a tree protected by that order without the authority’s permission.
The purpose of a tree preservation order is to protect trees which bring significant amenity benefit to the local area. An order can protect anything from a single tree to all trees within a defined area or woodland. Any species can be protected, but no species is automatically protected by a tree preservation order. It is an aid to plan making and not a statement of Council policy. Specifically it informs the preparation of the Local Plan Core Strategy and the subsequent Development and Site Allocations DPD.
A positive assessment of individual sites does not indicate these sites will definitely be developed and does not outweigh or alter any existing policies or land use designations. However, the SHLAA does provide evidence that will be kept up-to-date and used to inform the preparation of the Local Plan.
It is noted that some of the sites identified in the SHLAA are the subject of a current planning application. However, inclusion within the SHLAA does not imply acceptance of any scheme, the details of which will need to be fully evaluated through the Development Management process, taking full account of all consultation responses and other representations received. It restricts the scope of permitted development rights either in relation to a particular area or site, or a particular type of development anywhere in the authority’s area. Where an article 4 direction is in effect, a planning application may be required for development that would otherwise have been permitted development. Article 4 directions are used to control works that could threaten the character of an area of acknowledged importance, such as a conservation area. It also includes information on other sites that have been assessed, but are not considered suitable, available or achievable for housing.
The SHLAA is a background 'evidence' document to inform plan-making, but is not a policy statement.

It serves to restrict Permitted Development rights usually in Conservation Areas. The aim of an Article 4 Direction is to encourage the retention of high quality architectural features and to preserve and enhance the character and appearance of the built heritage. Enhanced planning controls are sometimes necessary because the designation of a Conservation Area only goes some way towards protecting the integrity of buildings and their character. Under the Town and Country Planning Act (General Permitted Development) Order 1995, permitted development rights enable property owners within a Conservation Area to undertake small-scale extensions and/or alterations without the need for planning permission. Where these rights are uncontrolled, unsympathetic alterations can erode the special interest of the Conservation Area. Article 4(1) Directions control changes to all elevations of a property whereas Article 4(2) Directions control changes to only "relevant" elevations of a property, these being elevations fronting a highway, including footpath, waterway or open space. As there may be some ambiguity regarding what constitutes an open space it is always advisable to check with a planning officer.
