From 1 April 2018 the conditions are: 1. You may only sublicense others to use it if you do so under a written licence which includes the terms (or equivalent) of these conditions and the agreement and in particular may not allow any period of use longer than the period licensed to you . 2. Notwithstanding the fact that the standard wording of the Environment Agency Conditional Licence indicates that it is perpetual, this Licence has a limited duration of five years at the end of which it will terminate automatically without notice. 3. We have restricted use of the Information as a result of potential personal data and other unknown confidentialities. The age of this dataset means that there is not sufficient information for a more detailed assessment. 4. This condition does not apply if use is limited to use that is authorised by any statute or use that does not require a licence from us. Before 1 April 2018 the conditions are: 1. You may use this Information for any non-commercial purpose (which is defined to mean a purpose not intended or directed towards commercial advantage or private monetary compensation) without charge but you must prohibit sublicensees or persons to whom any sublicensee passes the Information from using this Information commercially and this prohibition includes placing the Information on a website from which it is possible to download for commercial use. 2. We normally charge for commercial use of this Information. You may use this Information for a commercial purpose if the geographical area intended to be used (whether under this or any other licence from us) is limited to a single area of 20,000 sq km or 10% of the records in this dataset. In either case, the area or records that you do not intend to use must be deleted after download, and you may not benefit from this condition more than once per year for this information. None of our operational Areas exceeds 20,000 sq km in size. You may not use larger areas commercially unless you contact us and arrange for a Special Licence Commercial and for payment of the relevant charge prior to making any commercial use, 3. You may only use this Information in accordance with permitted contractor use under condition 4 or non-commercial use permitted under condition 1 or commercial use if permitted under condition 2 and in the cases of non-commercial use or commercial use subject to condition 5. 4. This Information may be used by you for the purposes of a contract you have to do work for us (and if you do not have a contract to do work for us no use is licensed), • for your internal use only but this does not prevent you from passing it back to us or (subject to condition 5 below) to a subcontractor who complies with these conditions and • you destroy all copies of the Information at the end of the contract subject only to any retentions necessarily required by statute or otherwise by legal obligation or for archive purposes for the sole purpose of addressing a complaint or challenge from a regulator or the National Audit Office in relation to your use of the Information. 5. You agree that, if you make any use of the Information in accordance with Conditions 1 or 2 your licence (unless terminated earlier) expires after one year at the end of which you must delete the Information. Should you wish to continue to use the Information, you must seek to obtain a new set of Information (if it is still available) with a new licence.
