The Environmental Permitting (England and Wales) Regulations 2010 introduce a single streamlined environmental permitting and compliance regime that applies to England and Wales. The 2007 Environmental Permitting Regulations integrated existing regimes covering Waste Management Licensing (WML) and Pollution Prevention and Control (PPC), and replaced over forty statutory instruments dealing with environmental permitting into a single instrument and re-transposed 11 European Directives. A list of these is available from IPC 17. A ‘regulated facility’ includes any of the above which carry out an activity listed in Part 2 of Schedule 1 of the Regulations. The operator of a new facility is required to obtain an environmental permit before they can lawfully operate. For operators who have outstanding WML, PPC permits, DC, GW and RSR authorisation, these will automatically become environmental permits on the coming into force of these Regulations. Existing mining waste operations have until 1st May 2011 to apply for an environmental permit and other existing mining operations have until 30th December 2010. Schedule 1 categorises activities as “Part A(1)”, “Part A(2)” and “Part B”. These categories are used to designate the regulator: = Part A(1) activities are regulated by the Environment Agency = Part A(2) activities are regulated by the local authority = Part B activities are regulated by the local authority
