public bodies not subject to Freedom of Information Act
Lots of public bodies are not subject to Freedom of Information Act - is it not time this was addressed?
To give some examples:
- ACAS
- Local Medical Committees (Statutory body representing GPs)
- Local Safeguarding Children Boards
- NHS Confederation
- Office of the Complaints Commissioner
- Office of the Schools Adjudicator
- UCAS
Totally agree, Section 1 of the FOI should by default be inclusive and strict scrutiny for any body that receives public money - directly eg NDPB's or indirectly eg Housing Associations, Charities etc - that has specifically asked to be exempt.
In one simple move, any body that we did not know about will become known as they ask for privacy, and partnerships that include or derive from public bodies will be under scrutiny too.

Sometimes small public bodies in NI are overlooked in UK legislation.
The Planning Appeals Commission in Northern Ireland claims that the FOI does not apply to it, even though it does apply to the Planning Inspectorate in England and Wales and and the ScottishDirectorate fro Planning and Environmental Appeals that have the same role in those countries.
The PAC refuses to release data and information that is freely available from those other bodies. This review of the scope of FOI must ensure consistency by including the PAC as a FOI body.
Last week the Protection of Freedoms Bill was introduced into the House of Commons. Amongst quite a few topics, this covers extending the Freedom of Information Act to apply to datasets. Today we launched a pilot Public Reading Stage for the Bill, where you can comment on each clause, with the comments being considered by Parliament at Committee stage. You might want to comment there on whether there should be an extension to the coverage of the Freedom of Information Act.
