Accessing CCTV footage

According to this government website, you are allowed to view CCTV footage after submitting a formal request as long as your request is not denied due to the Data Protection Act 1998 (designed to protect the privacy of the members of the public).

Can anyone explain the criteria that would cause a request for a piece of footage to be denied?

I'd like to understand what are the non-technical barriers to an individual accessing CCTV camera footage in realtime or as close to realtime as possible.

My understanding of it is, basically, the law protects the privacy of the third party when you request to see footage.

So the CCTV footage you request to see has to be, for example, of you wandering the streets, not other people wandering the streets - as that would infringe their privacy. People in control of the CCTV cameras (data controllers) are bound by law to comply with this request, but it often means editing gigabytes upon gigabytes of digital footage to include the frames of the subject only, and not other people.

I figured that would be the case.

I wonder what would happen if everyone asked to see footage of themselves in public places. I assume the gov.uk would be bound to provide access of some sorts and have a resourcing nightmare.

I also guess this problem was hit head on and overcome by the google streetmap application that obscured peoples faces and removed frames at peoples request.

I do find it peculiar that I'm not allowed to view via a camera that is watching me, the public space i'm in and all the things I can plainly see before me using my own eyes due to a point of privacy.

I was wondering whether there could be applications developed (entertainment?security?) but I guess the privacy laws trump any approach unless we can somehow automatically remove PII.

I suggest you have a look at ico.gov.uk - The Information Commissioner's website. This is the body responsible for both Data Protection and FoI laws.

There is some useful guidance on CCTV and the DPA, and your right to view images of yourself.

my son wa arrested and I asked to see the cctv, they had already cautioned him but they said if i wanted to see it they would prosecute him, he was in a fight in town but i think they were tough handed with him, he was cut and bruised from them.

Hi, can anyone help. I have heard that someone has gained access to CCTV via deception at our local swimming club. The fottage will obviously contain images of mine and other peoples children and I wanted to know if anyone can tell me if this is unlawful and therefore a civil offence???

I think it depends on who the person is and what they have done with the footage. If they have posted it on youtube then they are in breach of privacy laws.

Hi can anyone help me please, I need to view a CCTV footage from a local street in oldham ASAP any idea how I can do that? I dont want to go through the police cause it has something to do with them.

The process can take quite some time to retrieve the footage and I can't quite see how they can manage it.  They will ask for what purpose you require the footage and I would be careful not to mention any issue with the police or otherwise.  Often there is a clause to say that footage cannot be used in any way to monitor or capture criminal activity etc. 

Best of luck with it though and hopefully nothing too serious.

Or better yet... How about doing away with the damn things altogether? Every Home-Office sponsored review so far undertaken proves beyond doubt that cctv does not prevent crime.

I find the thought of anyone being able to access cctv footage scary. Surely this can't be allowed.

Hi Josh, If you find the fact that anyone can watch CCTV scary, then you should check you Internet Eyes. It is a website that has CCTV streamed to it in real time so that people can try to spot wrong doing and win rewards for reporting it. I personally think its a great idea and hopefully with this, it may just start to deter a few criminals if it works. I think the only people who need to fear CCTV are the criminals, if your not a criminal then there is nothing to worry about.

I would like to access CCTV footage of myself in a pub. I was robbed of my bag and have reported this to the police but they have decided not to investigate. I would like to see if I might recognise who robbed me as I am a regular at the pub.

In these circumstances, is it possible to gain access, and how would I go about doing this?

You should not rely heavily on video. I looked through the video after the phone was stolen at a bar. The recording quality is very bad, very difficult to identify people.

Hi, having read your post I have done a short article on my website for you with a simple step by step way of asking for the CCTV footage, together with an example form to complete to send to the pub in question.

In short - you can ask for any CCTV footage from the owner of the system due to the Data Protection Act 1998 and they have 40 days to supply it to you - the form includes space for your name, description and if you also attatch a photo of yourself, this will all help the system controller identify you and the theft. Obviously the more information you can give, the better the likelyhood that they can find you and be able to send you the information you need.

Can't be right for anyone to be able to access CCTV footage. It allows anyone to check on anyone elses movements.

BOL - no it isn't there are laws in place to protect you and you can't "just request any CCTV footage". The Data Protection Act covers your privacy.

Theres a few good websites that you can use to watch livee cctv footage. We use http://www.livewebcams.org.uk/ daily. Granted there are not many that are listed but there are some very decent ones that are in the UK. I hope it helps!

That live cam website is great. I've only found a couple of working websites that allow you to view CCTV footage, and most of them are delayed. I have found a few that allow you to more the camera! That is FUN!

As a third party you can't get access to view public footage that gov hold, until and unless you request to respective office. Because as it is public you have to take permission. You can get it from Comissioner office.

I heard that CCTV cameras help to catch 2/10 criminals... which is not extremely helpful unfortunately...
